INFORMATION REGARDING THE TRANSFERRING OF A LOAN

Be advised that the transfer of servicing does not affect any other terms or conditions of a mortgage or its loan documents, other than the terms directly related to the servicing of the loan.

PRIOR TO THE LOAN TRANSFER DATE

  • You will be notified, via written correspondence, of the date in which the servicing of your loan will be transferred to Nationstar Mortgage LLC.
  • Until such notification is received, continue to make payments and inquiries regarding your mortgage loan to Seneca Mortgage Servicing LLC using the information provided below:

AFTER THE LOAN TRANSFER DATE

  • If your loan transfers to Nationstar Mortgage LLC, a welcome packet will be mailed to you from Nationstar Mortgage LLC containing your new loan number as well as additional details regarding the transfer.
  • After your mortgage loan has transferred to Nationstar Mortgage LLC, Seneca Mortgage Servicing LLC will forward any written correspondence and payments received to Nationstar Mortgage LLC for processing.
  • If your account was setup on automatic drafting (ACH) this service will continue with Nationstar Mortgage LLC. A confirmation authorization will be mailed from Nationstar Mortgage LLC and is required to be signed and returned within 90 days to avoid interruption of this service.
  • If you have monthly recurring payments set up at your bank from your personal bank account, it is very important that you update the payee to be Nationstar Mortgage LLC, and be sure to update the account number with your new Nationstar Mortgage LLC loan number.
  • If you are currently being escrowed for taxes or insurance, Nationstar Mortgage LLC will continue to escrow for those items and pay bills from your escrow account.
  • If your account is in an active loss mitigation, this request will remain active. All documentation will be transferred to Nationstar Mortgage LLC who will decision the workout options.
  • If you mail your monthly mortgage payments, all future payments, after your loan transfers, should be sent to:

  • At year end you will receive a statement of account from both Seneca Mortgage Servicing LLC and Nationstar Mortgage LLC, reflecting all payments made to each servicer individually. These statements are required when filing your tax return for the applicable year.

 

Important notice containing information required under RESPA concerning the transfer of servicing.

CONSUMER RIGHTS

You should be aware of the following information, which is set out in more detail in section 6 of the Real Estate Settlement Procedures Act (RESPA) (12 U.S.C. Section 2605):  During the 60 day period following the effective date of the transfer of the loan servicing, a loan payment received by Seneca Mortgage Servicing LLC before it’s date may not be treated by your new servicer – Nationstar Mortgage LLC as late, and a late fee may not be imposed on you.

Section 6 of RESPA (12 U.S.C. Section 2605) gives you certain consumer rights.  If you send a “Qualified Written Request” to your loan servicer concerning the servicing of your loan, your servicer must provide you with a written acknowledgment within 5 days (excluding legal public holidays, Saturdays and Sundays) of receipt of your request unless the action requested is taken within such period. A “Qualified Written Request” is a written correspondence, other than notice on a payment coupon or other payment medium supplied by the servicer, which includes your name and account number and your reason for your request.

No later than 30 days (excluding legal public holidays, Saturdays and Sundays) after receiving your request, your servicer must make any appropriate corrections to your account and must provide you with a written clarification regarding any dispute.  During this 30 day period, your servicer may not provide information to a consumer reporting agency concerning any overdue payment related to such period or qualified written request.  This 30 day period may be extended by up to 15 days if before the end of such 30 day period the servicer notifies you of the extension and the reasons for the delay in responding.  However, this does not prevent the servicer from initiating foreclosure if proper ground exists under the mortgage documents.

Section 6 of RESPA also provides for damages and costs for individuals or classes of individuals in circumstances where servicers are shown to have violated the requirements of that section.  You should seek legal advice if you believe your rights have been violated.
